Google Makes A White Spaces Concession.

In yet another chapter of “Why Citizens Movements Are Citizen Driven,” I think Google has conceded too much too soon in its letter today to the FCC. Briefly, in an effort to try to head off the persistent claims that the white spaces prototypes have “failed” and to move out of the wireless microphone trap that opponents of white spaces have used so effectively, Google proposes a combination of “beaconing” (give users of wireless microphones a low power gadget that mimics a dtv signal, thus denying use of the vacant channel to any white spaces device (WSD) in the immediate vicinity, as the WSD will interpret the channel as “active”) combined with setting aside channels 36-38 for wireless microphones, and requiring geolocation and a “permission to activate” signal from higher power stationary devices.

Reform Week At the FCC — And Why Letting In The Public Is Better

(Sadly, the original version of this got lost in the disk failure we had Tuesday. So this is a somewhat shorter reconstruction.)

With both Republicans and Democrats interested in reforming the FCC for their own reasons, it seems a perfect time to crank out a new white paper on reforming the FCC. As you can see from the press release, Common Cause and my employer Media Access Project have released a new white paper called Puting the Public Back In Public Interest: Painless Reforms to Improve the FCC, authored by yr hmbl obdn’t, fellow Wetmachiner Gregory Rose, and Common Cause’s Jon Bartholomew. Astute readers with good memories will recognize many of the recommendations from previous posts and writings of mine, including this from this speech I gave back in 2003. Most of these issues have festered for years, for all that they have gained recent notoriety.

In the same vein, I draw attention to Matthew Lasar’s piece, 5 Ways to Improve FCC.GOV, on his generally excellent FCC Blog Lasar’s FCC Letter. Lasar’s suggestions are good, and many of them are echoed in our white paper (although derived independently, great minds think alike and all that).

Coincidentally, a different piece by Matt, “Faux Celebrity Comments At the FCC,” triggered a serious question by Adam Thierer at the Progress and Freedom Foundation blog. Given that we have situations in which a single organization such as Parent’s Television Council is able to generate thousands of identical comments from its members, and that others are using fake names, and that there are even allegations that NAB submitted false comments fake brief text comments opposing the Xm-Sirius merger, or used deceptive means to get people to send in such comments, is there any real value in making it easier for the public to file brief comments? Doesn’t that just create opportunities for confusion and abuse, warping the regulatory process and shifting power away from the real public to the manipulators and unscrupulous?

Matt gave his answer here, in which he makes reference to what I call the “Alice’s Restaurant” rule of public comments: If one commentor says ‘my media sucks because of consolidation,’ that’s an outlier and you ignore it. If two people file, ‘my media sucks because of consolidation,’ then it’s just tree huggin’ liberals and you ignore it. But if two million people file such comments, that’s data—because we’ve demonstrated enough people care to at least make a minimal effort to express their feelings.

To amplify a bit, I would certainly like to see anyone who submits fake comments designed to persuade the FCC that people support a particular position when they don’t, either by forging their names and email addresses or obtaining these through deceptive means, should be subject to criminal penalties under 18 USC 1001. But I do not dismiss the ability of an organization to get its members to file a boatload of identical comments or complaints through a comment engine. This is the modern equivalent of the petition drive. In a previous generation, the determined citizen might spend a day in a mall parking lot or knocking door to door to get signatures on a petition in support of some candidate or in opposition to some law. Signing something in a parking lot to “send a message about global warming” or “show Washington you hate big government” takes about as much time and understanding as filling out the info in a standard “comment engine,” and tells us the same thing — a broad base of citizens cares at least enough to take a minute to send a message rather than just ignore it.

Policymakers have long experience with petitions and petition drives. They understand the difference between a petition with 10,000 names, 100 individual letters that talk about real life experiences, and the 5 people who take the trouble to actually call or make a visit to discuss their case. Each of these forms of contact provides a type of information, and decisionmakers weight it accordingly — or should.

In addition, as I went on at length after the media ownership vote, the entire regulatory process gains validity when the public perceives it has a meaningful way of communicating with regulators and can monitor the process. Taking brief text public comments in a a simple and straightforward fashion, and allowing the public to follow who files and how many people file, is an important aspect of this.

Finally, it reconfirms for those that have filed that they are not alone (or, perhaps, that they are), helping interested members of the public to organize and engage in discussion with each other. It provides a focal point for concerned citizens to act as citizens and make themselves heard in a way that goes beyond the mere ritual of voting. Even if public comments had no other value, it would be worth it for this benefit alone.

Which is why, I suppose, I’ve been such a fan of FCC reform for so many years. It’s not just about getting better data and creating a process that everyone perceives as more open and fair. These are important. But it is also about something more vital. Ensuring that in our modern administrative state, when so much of our government in a democratic society seems beyond our control, any means by which we maintain the vital link between the government and the governed is to be cherished and nurtured. It reminds us that we are free people in the land of the free, with both the right ad the responsibility to participate in the government decisions that matter to us. We are not spectators in our own lives, nor helplessly awaiting the decisions of others. We are citizens, from whose consent all sovereignty arises, and without whose consent sovereignty is tyranny. When we speak, the FCC (and the rest of the federal government) owes it to us to listen.

Brief update on White Spaces

For those following the current White Spaces follies (or, “how Microsoft crashed an entire proceeding by treating spectrum as if it were software”) the FCC announced it will do further testing on white spaces prototypes.

That’s a modest victory for pro-white spaces forces, as the NAB had tried to leverage the failure of the (broken) Microsoft device to force the FCC to shut down the proceeding (or, more realistically, go with stationary devices and say no to mobile devices, with sufficient restrictions on power level and use of adjacent channels to make the white spaces virtually useless). At the same time, however, it ups the stakes pretty severely. Another “blue screen of static” and the NAB will probably get its way.

My sense is that a majority of Commissioners would like to see this happen, if they are convinced the engineering works. That doesn’t just mean a proof of concept. That means a demonstration that the technology today works sufficiently well that the FCC’s Office of Engineering and Technology can say with confidence “if devices follow these rules, they will not interfere with people trying to watch free over-the-air TV.” We know the theory works, but is the technology ready for prime time?

Broadcasters Leverage Monopoly on TV Channels to Push Vacant Channel FUD (Fear, Uncertainty, Doubt)

It’s always nice when you can give yourself free advertising time on television. So no surprise the National Association of Broadcasters has launched a major advertising campaign in the DC Area to persuade members of Congress that allowing unlicensed use of the broadcast white spaces will mess up the transition to digital television. Indeed, the NAB has made this into a grand campaign, including a new website called “Interference Zones” complete with adorable graphics of “Wally, the Unlicensed Wireless Device” messing up the “pristine digital television signal” to your “beautiful new digital TV.” I particularly like how they got Wally’s fun-loving but malicious grin rendered so “pristinely.”

And, in case you missed it the first time, the site also contains a link to the Association for Maximum Service Television classic “educational” video Your Neighbor’s Static. “Your Neighbor’s Static” is as realistic a portrayal of the effects of white spaces devices on TV as Reefer Madness is a balanced documentary on the pros and cons of medical marijuana.

It’s all just the usual fun and games here in DC, and a fine example of why the broadcasters have so much power as a lobby.

NAB Turkey of A Report

As reported at Consumers Union Hearusnow.org blog The National Association of Broadcasters has done its best to show that owning broadcast stations loses money. Unsurprisingly, they recommend relaxing local ownership rules to allow owners to chase the happy, mythical synergy rainbow that has proven such a winner for Clear Channel, Tribune, Viacom and growing list of companies that absorbed profitable businesses and turned them into failing operations ladden with debt.

We shall leave aside the absurdity of the NAB’s arguments for the moment to get to something even sillier, the absurdity of the NAB’s math. Not since fictional Fundamentalists supposedly redefined Pi as 3 has ideology so distorted the basic precepts of mathematics. Worse, these are not accidents or “fudging.” I count no fewer than two major errors in methodology or presentation per page as well as many major methodological errors that impact the paper overall.

How bad is this paper? It is so bad that you would expect it to appear in the “April Fools” edition of Econometrica. It is so bad that I would expect its author, Theresa J Ottina, to be banned for life from meetings of the American Economic Association. It is so bad that every professor of economics and statistical analysis should download it and give it to their class as a final exam question to see if the class can spot all the errors as a kind of economics “Where’s Waldo” of mistakes, gaffes, and deceits. It is such a botched attempt at a lie by statistical analysis that I have half a mind to file a complaint with the FCC requesting they sanction NAB and Ms. Ottina for violating the FCC’s requirement that submissions reflect an honest effort to provide true information (a certification NAB made in its filing).

What makes it so bad? And why does the NAB submit such a piece of obvious crap?

Tales of the Sausage Factory: Goodies for the Broadcasters, Zip for the Public

Only in Washington would the Clear Channels of the world, those great champions of efficiencies and deregulation, declare that their monopoly on local content must be protected with regulation. And only in Washington would the deregulatory anti-big-government Republicans lap it up with a spoon. The National Association of Broadcasters (NAB) has petitioned the FCC and Congress to prohibit the new satellite radio competitors from providing local content (mostly traffic and weather). Of course, this is moving at hyperspeed, while the effort to impose real public interest obligations on the broadcasters moves at one quarter impulse. Still, I can’t help stirring the pot at the FCC and seeing what bubbles up.

Unlicensed Spectrum in TV

The FCC has released its eagerly anticipated (or dreaded) Notice of Proposed Rule Making which would authorize the use of unlicensed spectrum access in the television bands. (Word, PDF, and Text). This is one of the real important proceedings before the FCC on unlicensed. You can be sure that major companies on both the pro-unlicensed and the anti-unlicensed side will file? But will you? Are you content to let Microsoft or Intel cut a deal with Viacom, News Corp and the rest of the media conglomerates for you? Or would you rather participate yourself and help define your own rights?
